Coal mine security supervision and law enforcement equipment management approach

First, the general

(1) To strengthen the management of coal mine safety supervision and law enforcement equipment (hereinafter referred to as law enforcement equipment), ensure the safe and reliable operation of law enforcement equipment, ensure the integrity and accuracy of law enforcement equipment, give full play to law enforcement equipment to improve the efficiency of coal mine safety supervision and enforcement, and enhance coal mine production. Promote the safety accident prevention capability, improve the coal mine safety supervision and law enforcement capabilities, and formulate these measures in accordance with relevant laws and regulations.

(3) The State Administration of Work Safety is responsible for the review and approval of the law enforcement equipment procurement plan and the provisioning plan, and supervises and manages the procurement and use of law enforcement equipment.

(4) The provincial coal mine safety supervision agencies shall be responsible for the preparation and declaration of the law enforcement equipment investment plans and equipment provision plans of the coal mine safety supervision institutions at the same level and the areas under their jurisdiction, and formulate rules for the management of law enforcement equipment.

(5) The law enforcement equipment management follows the principle of “who uses and who is responsible”. The fixed assets registration unit of law enforcement equipment is the responsible unit for the use, maintenance and maintenance of law enforcement equipment. There should be corresponding internal institutions to manage the law enforcement equipment.

Second, law enforcement equipment configuration

(6) The allocation of law enforcement equipment shall adhere to the principles of safeguarding needs, scientific and advanced, safe and reliable, energy-saving and environmental protection, and strict control. The minimum service life of law enforcement equipment shall comply with the relevant requirements. (7) The provincial and regional coal mine safety supervision agencies may apply for law enforcement equipment configuration if they have one of the following conditions:

1. New institutions or staff establishments;

2. Increase work functions and tasks;

3. The existing law enforcement equipment needs to be configured after reaching the minimum service life and disposing it according to the regulations;

4. Existing law enforcement equipment cannot meet other situations that require coal mine safety supervision and enforcement.

(8) Equipped with law enforcement equipment including purchase, adjustment and so on. Anything that can be solved by means of adjustment is not allowed to be purchased in principle.

(9) The provincial-level coal mine safety supervision institution may integrate the actual work needs of the coal mine safety supervision institutions at the same level and the region, and uniformly submit an application for the law enforcement equipment allocation and submit the equipment plan to the State Administration of Safety Supervision. Third, law enforcement equipment procurement

(10) The law enforcement equipment that the State Investment Management Department and the State Administration of Work Safety expressly require in bulk procurement shall be organized in a unified manner in the form of centralized procurement by the department, and public bidding shall be implemented.

(11) For the procurement of law enforcement equipment that is not clearly required, the provincial coal mine safety supervision organization shall organize the implementation in accordance with the relevant provisions of the local government procurement.

(12) The law enforcement equipment that has been determined to be purchased by the provincial coal mine safety supervision organization, involving safety signs, measurement certification and independent intellectual property rights management, shall also comply with the relevant provisions of the special management of the relevant state departments.

Fourth, law enforcement equipment use maintenance and daily management

(13) All provincial and regional coal mine safety supervision agencies shall clarify the law enforcement equipment management agencies and personnel, improve the internal management systems such as equipment acceptance, account entry, requisition, custody, maintenance and repair, standardize work procedures, and strengthen the daily management of law enforcement equipment.

(14) All provincial and regional coal mine safety supervision institutions shall establish and improve the law enforcement equipment account card and file management system, establish and improve the law enforcement equipment management information system; the new law enforcement equipment shall be timely checked and accepted, registered and accounted for, and equipment changes shall be made. The situation is entered into the equipment management information system. Among them, the law enforcement equipment entry vouchers are the basis for financial processing.

(15) All provincial and regional coal mine safety supervision agencies shall establish a system for the return of law enforcement equipment. If the supervisory personnel and the organization are equipped with law enforcement equipment, they shall go through the formalities for the application; if the personnel are transferred (retired), they shall go through the procedures for return or scrap.

(16) All provincial and regional coal mine safety supervision agencies shall implement the responsibility for law enforcement equipment management to positions and personnel to prevent abnormal losses and waste. If the law enforcement equipment causes abnormal loss and waste, the relevant responsible person shall bear corresponding responsibility.

(17) All provincial and regional coal mine safety supervision agencies shall strengthen the routine maintenance and repair of law enforcement equipment to ensure that the assets perform well during the specified period of use.

(18) All provincial and regional coal mine safety supervision agencies shall conduct a comprehensive inventory check of assets every year, and adjust relevant account cards according to regulations to ensure that the accounts, accounts, accounts and accounts are consistent. For the problems found in the inventory check, the cause should be ascertained, the situation should be explained, and it should be reflected in the relevant annual final report.

(19) All provincial and regional coal mine safety supervision agencies shall strengthen the use and management of law enforcement equipment, and may not rent or lend without approval.

(20) The maintenance and maintenance of mine explosion-proof law enforcement equipment must implement the national standard "Explosive Environment" (GB3836) and other relevant regulations.

(21) Law enforcement measuring instruments must implement the "Measures Law of the People's Republic of China" and other relevant regulations.

5. Law enforcement equipment disposal

(22) Law enforcement equipment that meets one of the following circumstances shall be in accordance with the Interim Measures for the Administration of State-Owned Assets of Central Administrative Institutions (Guo Guan Zi [2009] No. 167) and the Measures for the Administration of State-owned Assets Disposal of Central Administrative Institutions ( State Administration [2009] No. 168), Circular on Issues Concerning the Disposal of State-Owned Assets of Central Administrative Institutions (Guo Guan Zi [2009] No. 246), and "Notice on Further Regulating the Disposal of State-owned Assets of Central Administrative Institutions" (National Management [2010] No. 165) and other relevant documents and these measures for disposal:

1. Idle or super standard configuration;

2. Changes in possession and use rights due to institutional changes;

3. To reach the end of life;

4. Due to technical reasons, it is unable to meet the needs of coal mine safety supervision and law enforcement;

5. Loss, bad debts and abnormal losses;

6. According to national and industry regulations, it needs to be disposed of.

(23) The disposal of law enforcement equipment should be combined with the allocation and use of law enforcement equipment, and gradually establish a mechanism for sharing and recycling law enforcement equipment.

(24) The disposal methods of law enforcement equipment include adjustment, donation, transfer, replacement, loss reporting, and scrapping.

(25) The law enforcement equipment disposal priority selection adjustment method; if it cannot be adjusted, it can be disposed of by means of transfer, replacement or donation.

(26) The disposal of law enforcement equipment shall strictly follow the formalities for examination and approval, and shall not dispose of itself without approval.

(27) The approval of the disposal of law enforcement equipment is the adjustment of assets and financial accounts. All provincial-level coal mine safety supervision agencies shall, in accordance with the approval of asset disposal, timely adjust assets and financial accounts, and handle relevant procedures such as registration of changes in property rights.

(28) The income from the disposal of law enforcement equipment shall be managed in accordance with the government's non-tax revenue and relevant state regulations.

(29) Assets such as computers, mobile storage media, fax machines and photocopiers involving state secrets shall be disposed of in accordance with relevant state secrets.

6. Supervision and inspection and legal responsibility

(30) All departments of the State Administration of Work Safety supervise and inspect the management of law enforcement equipment of provincial and regional coal mine safety supervision agencies in accordance with their respective duties, and accept supervision by the financial, auditing departments and the public.

(31) The relevant departments of the State Administration of Work Safety conduct a major inspection of the implementation of the management system for the use and disposal of law enforcement equipment.

(32) All provincial-level coal mine safety supervision agencies shall seriously rectify the problems examined and report the rectification to the State Administration of Safety Supervision.

(33) If the coal mine safety supervision institutions and staff at all levels violate the provisions of these Measures, they shall be dealt with in accordance with the Regulations on the Disciplinary Measures of Civil Servants of the Administrative Organs (Order No. 495 of the State Council) and relevant state regulations; if losses of state-owned assets are caused, the responsibility shall be investigated according to law. .

Seven, the supplementary

(34) All provincial and regional coal mine safety supervision agencies shall formulate implementation measures for the implementation of law enforcement equipment in their respective departments in accordance with these Measures.

(35) The National Security Administration is responsible for the interpretation of these Measures.

(36) These Measures shall come into force as of the date of issuance.
